“Law Will Prevail,” Chief Justice Warns Against Politicizing Kolkata Doctor Case

New Delhi, 22nd August. Chief Justice of India DY Chandrachud today urged both the Centre and West Bengal counsels to refrain from politicizing the Kolkata doctor’s rape and murder case, emphasizing that the legal process must proceed unimpeded. This call came amid a heated exchange between Solicitor General Tushar Mehta and Bengal government’s counsel Kapil Sibal during a Supreme Court hearing.

Sibal asked the court to prevent inflammatory statements, to which Mehta responded with concerns about comments made by a West Bengal minister threatening violence against critics. Sibal countered with a reference to a statement by the Leader of the Opposition, invoking further controversy. The Chief Justice stressed, “Please don’t politicize this; the law will take its course. We are ensuring a prompt and thorough investigation.”

The case has sparked significant political tension, with the BJP protesting and accusing the ruling Trinamool Congress of fabricating allegations. In response, the Trinamool Congress has countered these claims, accusing the BJP of attempting to tarnish the state government’s reputation.

The Supreme Court bench, which also includes Justices JB Pardiwala and Manoj Misra, expressed concern for the safety of healthcare workers. The court has vowed to issue enforceable directives to address these issues. During the proceedings, concerns were raised about potential repercussions for doctors participating in protests demanding justice and improved working conditions.

The Chief Justice emphasized that justice and medical care cannot be compromised, urging doctors to return to work, assuring them that no adverse actions would be taken against those who comply. The court highlighted the need for uninterrupted medical services, noting that delays in medical appointments can adversely impact vulnerable populations.

Amid these concerns, the Supreme Court has established a National Task Force to recommend measures for improving the safety and working conditions of healthcare professionals.
