New Delhi, 3rd Jan. The Supreme Court on Wednesday stayed the Himachal Pradesh High Court’s order to transfer senior IPS officer Sanjay Kundu from his position as Director General of Police (DGP).
The decision to shift him was made in order to prevent him from influencing the investigation into the alleged harassment of businessman Nishant Sharma in Palampur.
The Supreme Court, led by Chief Justice DY Chandrachud, has given Kundu the freedom to approach the high court and request the recall of its December 26 order.
The court has stated that the transfer directive will remain on hold until the high court makes a decision on the recall application.
On Tuesday, Sanjay Kundu was removed from his position as Himachal DGP and reassigned as Principal Secretary in the Ayush department.
The Himachal Pradesh High Court had previously ordered the state government to transfer the DGP and Kangra Superintendent of Police Shalini Agnihotri to different positions before January 4, 2024, to ensure that they could not influence the investigation.
The businessman had sought the intervention of the High Court, expressing the need for protection from powerful individuals as he lived in constant fear of being killed.
Kundu’s lawyer informed the Supreme Court that the situation was exceptional, as the high court did not hear the officer’s side before issuing the transfer directive.
