New Delhi, 21st July. The Supreme Court said on Thursday that it will await the decision of the Varanasi district judge on the Gyanvapi mosque committee’s application raising objections to the maintainability of the civil suit filed by Hindu devotees.
A bench of Justices DY Chandrachud, Surya Kant, and PS Narasimha has scheduled a hearing on the appeal of the Gyanvapi mosque committee’s plea against the Allahabad High Court order upholding the appointment of a court commissioner to survey the site for the first week of October.
The bench stated that it has been informed that proceedings before the District Judge are still ongoing and that it would be appropriate to keep the appeal of the mosque committee pending until the outcome of the application filed under Order 7 Rule 11 questioning the suit’s maintainability.
On May 20, the Supreme Court transferred the civil suit filed by Hindu devotees against the Gyanvapi mosque from civil judge (senior division) to district judge, Varanasi, stating that given the complexities and sensitivity of the issue, it is preferable that this case be handled by a senior judicial officer with over 25-30 years of experience.
