Guwahati (Assam ) 6 September -A storm of allegations has engulfed Chaygaon in Assam, where Congress councillor Anwar Hussain, elected from the Palashbari constituency, is accused of systematically cheating a grieving Hindu family, looting their savings and insurance, and staging an illegal interfaith marriage with their daughter under a kazi, despite already being married himself. The case exposes not just personal betrayal but also a glaring failure of law enforcement.

A Family Shattered by Tragedy

On 17 October 2021, Chandrdhar Kalita, a retired schoolteacher from Chaygaon, died in a tragic road accident. His sudden death left his widow and daughter devastated, struggling emotionally and financially.
With no knowledge of legal paperwork and no nominee in his bank or insurance accounts, the Kalita family was vulnerable. Into this vacuum stepped Anwar Hussain, who presented himself as a “well-wisher” offering help with their bank and insurance claims.
But what started as sympathy soon turned into a trap.

Looting Bank Savings and Insurance

Kalita had ₹8.5 lakh in his bank account, but since no nominee was registered, Hussain arranged to make the widow the nominee. Once the paperwork was done, he allegedly exploited her illiteracy — taking her signatures, withdrawing large amounts, and keeping most of the funds.
According to relatives, he only handed over small sums occasionally, just enough to give the impression of support.
The same pattern was repeated with the Motor Accident Claims Tribunal (MACT) case, where around ₹10 lakh in compensation was awarded. Hussain allegedly siphoned this off, claiming it was a “loan” he would repay — a promise never fulfilled.
“He robbed us in broad daylight using our trust and ignorance,” said one relative.

From Helper to Master

Over two years, Hussain entrenched himself in the household. He made financial decisions, isolated the family, and reportedly threatened the daughter, telling her she could not marry anyone else.
“He behaved as if he owned us. He scared our daughter, saying she had no choice but to stay under him,” the family alleged.

The most disturbing twist in the Chaygaon case unfolded when the Kalita family began exploring marriage proposals for their daughter. On the very day prospective grooms’ families were scheduled to meet her, Anwar Hussain staged a shocking drama.
With the help of a local kazi , Hussain had already conducted a so-called nikah in 2024, but this “marriage” was nothing more than a fraud. The girl never gave consent, the family was completely unaware, and the so-called certificate carried no signatures of the daughter. In effect, it amounted to a forged document and a forced religious conversion of a Hindu girl without her knowledge.
Legally, this so-called union holds no ground. In Assam today, interfaith marriages cannot be validated through a kazi; they must be solemnized under the Special Marriage Act (SMA), 1954 with the free will of both parties. Hussain not only bypassed the law but also concealed the entire act from the girl’s family.
When genuine marriage arrangements for the daughter were taking place this Sunday, Hussain allegedly lured her out under false pretenses and kidnapped her, leaving the family shocked and devastated.

Why the Marriage Is Invalid

Under current law in Assam, kazi-conducted interfaith marriages are no longer recognized and are illegal . For a Hindu-Muslim marriage to be legal, it must be solemnized under the Special Marriage Act (SMA), 1954, with the free and informed consent of both parties.
Legal experts confirm that:
A nikah without consent and without SMA registration holds no legal standing.

Any attempt to convert and marry a Hindu girl without her explicit knowledge is a criminal act of fraud and coercion.

Since Hussain already has a wife, the act is also tantamount to bigamy.

Thus, what Hussain orchestrated was not a marriage — but a criminal conspiracy disguised as one.

FIR Filed, Police Under Fire

The Kalita family lodged an FIR at Chaygaon Police Station, charging Hussain with fraud, cheating, breach of trust, abduction, bigamy, and forced religious conversion.
But despite the gravity of the charges, the police response has been lethargic. Officials continue to claim they are “searching” for Hussain, though he is a known councillor with public presence.
The officer-in-charge’s lack of urgency has raised suspicions ,political interfernce Locals openly allege that Hussain enjoys protection due to his Congress links and may have “favored” officials in the past.
“This delay shows criminals have more power than law-abiding citizens. If police can’t catch a sitting councillor, what hope do ordinary families have?” asked a local community leader.

A Dangerous Precedent

This case is no longer about one family’s tragedy. It raises disturbing questions:
Can elected representatives openly loot and manipulate without fear?

Can illegal kazi marriages and forced conversions still occur, even after the law mandates SMA for interfaith unions?

Is police inaction allowing political figures to operate above the law?

Hussain could face multiple charges under the IPC, including cheating, criminal breach of trust, abduction, bigamy, and illegal conversion and kidnapping a Hindu girl — crimes that together carry heavy penalties.

A Cry for Justice

For the Kalitas, justice feels distant. They lost their patriarch in 2021, their financial security was plundered, and now their daughter has been trapped in a fraudulent, illegal marriage.
“This is not just about money. This man destroyed our dignity, our trust, and our daughter’s future. If police remain silent, then justice has died in Chaygaon,” the widow said, breaking down.

A Test for Assam Police

The Chaygaon case has now turned into a litmus test for Assam’s law enforcement machinery — and the results so far are deeply troubling. Despite living in an era of CCTV surveillance, mobile tracking, and advanced policing tools, the police have failed to arrest or even trace Anwar Hussain, a sitting councillor whose whereabouts are hardly a mystery in his constituency.

This glaring inaction raises disturbing questions: Are the police truly powerless, or are they deliberately protecting him? Is political influence outweighing their duty to enforce the law? Why is an elected representative, accused of fraud, abduction, and an illegal marriage, still free while a grieving Hindu family cries for justice?

For the Kalita family, every day without action is a nightmare. Their daughter’s future hangs in the balance, and their faith in the justice system crumbles. Meanwhile, Chaygaon watches with rising anger and a chilling question: If Assam Police cannot protect the innocent from powerful predators, then who is the law really serving?
