New Delhi, 15th Feb. India has entered into an agreement with Poland to facilitate the issuance of summons and search warrants for individuals residing in either country in connection with criminal matters.
The Union Home Ministry issued a notification announcing the arrangements made by the central government with the government of the Republic of Poland for the service or execution of summons or search warrants in criminal cases involving individuals in Poland.
Under the agreement, summonses or search warrants issued by Indian courts may be transmitted in duplicate to the competent authorities in Poland, namely, the Minister of Justice or the Prosecutor General, or their authorized representatives, for execution.
The notification emphasized that Indian courts issuing summonses must adhere to the comprehensive guidelines issued by the Ministry of Home Affairs in 2019.
Furthermore, in cases where Indian courts execute summonses or search warrants received from Polish authorities, the documents or items obtained through searches shall be forwarded to the issuing court in Poland through the IS-II Division of the Ministry of Home Affairs, Government of India.
Additionally, the commission for the examination of witnesses in Poland shall be issued by Indian courts in a prescribed form and transmitted to the competent criminal courts in Poland through the IS-II Division of the Ministry of Home Affairs.
This agreement aims to enhance legal cooperation between India and Poland in criminal matters and streamline the process for legal proceedings involving individuals residing in either country.
