Delhi HC Rejects Plea to Halt Spicejet Flights

New Delhi, 18th July. The Delhi High Court on Monday dismissed a public interest litigation (PIL) seeking to halt SpiceJet’s operations for allegedly flying its aircraft in violation of professional and safety standards.

The court cannot stop an airline’s operations based on a PIL and news reports, observed a bench led by Chief Justice Satish Chandra Sharma while hearing the plea of lawyer Rahul Bhardwaj.

The bench, which also included Justice Subramonium Prasad, remarked that the statute offered a “strong system” for the aviation sector and noted that the DGCA has already commenced action and issued show cause notices in respect to the instances detailed in the current case.

The petitioner claimed that there had recently been incidents involving SpiceJet aircraft “landing,” its aircraft taking off without passengers’ luggage, and staff not being paid.

The court stated that the “DGCA is very much working” and that there is no cause to give the petitioner’s requested relief.

“The court cannot prohibit a certain airline from operating in the nation based on allegations in a PIL and press clippings,” it added.
