New Delhi, 27th Dec: The Central Bureau of Investigation (CBI) on Friday moved the Supreme Court challenging the Delhi High Court’s order suspending the life sentence and granting bail to expelled BJP MLA Kuldeep Singh Sengar in the 2017 Unnao rape case, officials said.

The probe agency filed a Special Leave Petition (SLP) in the apex court after reviewing the high court’s ruling, which had suspended Sengar’s life term during the pendency of his appeal. A CBI spokesperson said the decision to challenge the order was taken at the earliest in view of the gravity of the offence and concerns raised by the victim’s family.

While the Delhi High Court on Tuesday granted bail to Sengar after noting that he had served over seven years in prison, he will continue to remain behind bars as he is also serving a separate 10-year sentence in the custodial death case of the survivor’s father.

Sengar had appealed against a December 2019 trial court verdict that convicted him of kidnapping and raping a minor girl in 2017. The CBI and the victim’s family had strongly opposed the plea, citing safety concerns and alleged threats.

Granting bail, the high court imposed strict conditions, including a personal bond of ₹15 lakh with three sureties and restrictions barring Sengar from entering within a five-kilometre radius of the survivor’s residence in Delhi or contacting her and her mother.

The Unnao rape case and related matters were transferred from Uttar Pradesh to Delhi in August 2019 on the directions of the Supreme Court.
