New Delhi, 20th Aug: In a landmark move in Parliament, Union Home Minister Amit Shah tabled three significant bills in the Lok Sabha on Wednesday. The bills were later referred to a Joint Parliamentary Committee for further examination.
The central legislation, the Constitution (One Hundred and Thirtieth Amendment) Bill, 2025, proposes that the Prime Minister, a Chief Minister, or any minister will automatically lose their office if they are arrested and detained for a continuous period of 30 days or more on charges punishable with at least five years in prison.
The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025 also seeks to fill a similar gap in the existing law by providing a mechanism to remove a Chief Minister or Minister in J&K under similar circumstances. Under the bills, a person removed from office can be reappointed once released from custody.
The government’s legislative push is based on the argument that officials facing serious criminal charges could jeopardize constitutional morality and public trust. The new laws are intended to strike a balance between upholding accountability and providing political opportunities.
