AIBA Seeks FIR Against Advocate for Attempted Attack on CJI Gavai

Bar body demands immediate police action; calls incident an assault on the dignity of the judiciary

New Delhi, 7th Oct: The All India Bar Association (AIBA) has written to Delhi Police Commissioner Satish Golcha, demanding the immediate registration of an FIR against Advocate Rakesh Kishore for allegedly attempting to hurl his shoe at Chief Justice of India (CJI) Justice B.R. Gavai during court proceedings on October 6.

In a statement, AIBA Chairman Dr. Adish C. Aggarwala condemned the act, describing it as an unprecedented and deeply disturbing incident within the Supreme Court. “The entire legal fraternity is shocked and appalled by this attempt to attack the Chief Justice,” he said, adding that such behavior strikes at the core of India’s judicial integrity.

Dr. Aggarwala, who has earlier served as President of the Supreme Court Bar Association, noted that while the CJI showed “magnanimity and composure” by not initiating contempt proceedings, the act qualifies as a serious offence under the Bharatiya Nyaya Sanhita, 2023 and warrants immediate police intervention.

He further stated that the incident has drawn condemnation from Prime Minister Narendra Modi, Union Law Minister Arjun Ram Meghwal, Solicitor General Tushar Mehta, and the Bar Council of India (BCI), which has already suspended Advocate Kishore from practice.

‘CJI’s Remarks on Vishnu Should Have Been Avoided’
Referring to the background of the incident, Dr. Aggarwala observed that it stemmed from a misunderstanding of the Chief Justice’s earlier courtroom remark. He said, “We feel it was unnecessary for the Hon’ble CJI to say, ‘Go and ask the deity itself to do something now. You say you are a staunch devotee of Lord Vishnu. So go and pray now.’ This statement was perceived as hurtful by many across the country. However, the indecent act committed by Mr. Kishore cannot be tolerated under any circumstances.”

Call for FIR Under Bharatiya Nyaya Sanhita
The AIBA chief emphasized that the act occurred within the jurisdiction of Tilak Marg Police Station and urged the Commissioner to register an FIR under Sections 131, 132, 229, 353, 356, and 309 of the Bharatiya Nyaya Sanhita, 2023, which pertain to assault on public servants, obstruction of duties, and public disturbance. He also pointed out that the video recording of the courtroom proceedings, available with the Supreme Court Registry, provides direct evidence of the incident.

‘An Affront to the Rule of Law’
Calling the Supreme Court “the highest temple of justice,” Dr. Aggarwala asserted that any act of aggression against its Chief Justice is “an affront to the entire judicial institution and the rule of law.” He urged the police to act swiftly and impartially to uphold the dignity of the judiciary and reinforce public faith in constitutional institutions.
