New Delhi, 27th Nov: The Supreme Court today advised comic Samay Raina to use his platform to promote dignity and awareness for individuals living with Spinal Muscular Atrophy (SMA), after he faced criticism for remarks perceived as mocking those with the condition. The bench made it clear that those affected are not seeking his money, but respect.
Appearing for an organisation representing SMA patients, Senior Advocate Aparajita Singh told the court that Raina’s jokes had ridiculed and hurt children battling the condition. She highlighted their accomplishments, noting that many have excelled across fields. Chief Justice Surya Kant echoed the sentiment, listing several examples — from professionals at Microsoft to scholars, artists and writers.
Singh noted that Raina had deposited ₹2.5 lakh after the controversy, but reiterated that the community seeks dignity above all. Responding to the concerns, the bench urged the Centre to consider framing a stronger law on the lines of the SC/ST Act to penalise offensive remarks against persons with disabilities. Solicitor General Tushar Mehta agreed, stating that humour must not come at the cost of someone’s dignity.
The court then asked Raina to consider hosting dedicated shows that feature SMA patients and showcase their achievements. It further suggested that comedians should invite persons with disabilities to such events, which could also help generate funds for timely treatment.
Expressing confidence in Raina’s willingness to support the community, the bench said it expects sincere efforts before the next hearing. It proposed that at least two such programmes be organised every month.
