Court Denies Unmarried Woman’s Plea to Terminate 28-Week Pregnancy

The Delhi High Court on Monday rejected the petition of a 20-year-old unmarried woman who sought permission to terminate her 28-week pregnancy. Justice Subramonium Prasad stated that the petition was denied.

Last week, the court had reserved its decision on the petition and had already indicated that it would not allow the woman to abort a fetus that was completely viable.

The judge had stated, “I cannot allow the termination of a completely viable fetus at 28 weeks. There is no abnormality in the fetus according to the report. We cannot permit foeticide.”

In her plea, the woman claimed that she became pregnant through a consensual relationship but only recently discovered her pregnancy.

Since the doctors refused to terminate the pregnancy due to it being beyond the legally permissible limit of 24 weeks, the woman sought permission from the high court to undergo a medical termination of her 28-week pregnancy under the Medical Termination of Pregnancy (MTP) Act.

The woman’s lawyer, Advocate Amit Mishra, argued that she was unaware of her pregnancy until January 25th when she discovered she was already 27 weeks pregnant. He also emphasized that the woman was unmarried and that her family was unaware of her condition, which should be taken into consideration.

Furthermore, he requested the court to order the All India Institute of Medical Sciences (AIIMS) to conduct a medical examination of the woman to assess her mental and physical condition, as well as the condition of the fetus.
