Prayagraj, 30th Jan. The Allahabad High Court has rejected the plea of a couple seeking security after their inter-religious marriage. The court stated that the marriage did not comply with the Uttar Pradesh Prohibition of Religious Conversion Act.
Justice Saral Srivastava dismissed the petitions filed by several couples from Moradabad and other districts.
The couples had requested the court to intervene and stop their families from interfering in their married life. They also sought protection due to threats to their safety.
The court ruled that this was a case of a marriage between individuals of different religions, and the proper legal process for religious conversion was not followed before the marriage. Therefore, the marriage is not considered valid under the law. The court emphasized that the anti-conversion law was not adhered to in this case.
However, the court mentioned that if the petitioners marry after following the appropriate legal procedures, they can reapply for protection.
The anti-conversion law, enacted in 2021, prohibits unlawful conversion from one religion to another through misrepresentation, force, fraud, undue influence, coercion, or inducement.
Among the eight petitions, five involved Muslim men marrying Hindu women, while three involved Hindu men marrying Muslim women.
It is worth noting that petitions challenging the constitutionality of anti-conversion laws in Uttar Pradesh, Madhya Pradesh, Gujarat, Uttarakhand, and Himachal Pradesh are currently pending before the Supreme Court.
