New Delhi, 5th Jan. The Supreme Court collegium, led by Chief Justice DY Chandrachud, has recommended five names to the Centre for the appointment of additional judges in four high courts.
The collegium, which also includes justices Sanjiv Khanna and BR Gavai, has also recommended the names of additional judges – justices Rahul Bharti and Moksha Khajuria Kazmi, both from the Jammu and Kashmir and Ladakh High Court – for appointment as permanent judges.
One of the recommendations suggests that additional judge Justice Abhay Ahuja should also be considered for appointment as a permanent judge in the Bombay High Court.
Several resolutions of the collegiums, uploaded on the top court website on Thursday night, provide details of the discussions leading to the recommendations of names of judicial officers and advocates for judgeship in high courts.
One of the resolutions states, “The Supreme Court Collegium has recommended the name of Smt. Chaitali Chatterjee (Das), Judicial Officer, for appointment as Judge of the High Court at Calcutta in the following terms…”
It also forwards the name of Arvind Kumar Verma, a judicial officer, for appointment as a judge of the High Court of Chhattisgarh.
While making the recommendations, the top court collegiums made it clear that the seniority of those whose names were recommended prior to Kapoor for appointment as judges of the High Court of Punjab and Haryana should not be disturbed.
The Collegium further resolves to recommend that two advocates, namely Harmeet Singh Grewal and Deepinder Singh Nalwa, whose names were approved by this Collegium earlier on 17 October 2023, be given precedence in the matter of appointment over Shri Rohit Kapoor. The inter se seniority of all three advocates should be fixed as per the existing practice.
The collegiums sought the assistance of consultee top court judges, in addition to considering the inputs of respective governments and the professional competence of individuals, before recommending the names for judgeship.
