VP Dhankhar Emphasizes Judicial Independence at Rajasthan HC’s Platinum Jubilee Celebrations

At the Platinum Jubilee Celebrations of the Rajasthan High Court, the Vice-President of India delivered a thought-provoking address highlighting the crucial role of the judiciary in maintaining the democratic vibrancy of the nation. He asserted that an independent and robust justice system is essential for effective governance, describing it as the lifeline of democracy.

The Vice-President emphasized the importance of the High Court and its Chief Justice in the justice delivery system, warning that any perceived or actual dilution would weaken the judiciary as a pillar of democracy. He stressed the need for strict adherence to the Doctrine of Separation of Powers, recognizing the distinct and critical roles of the legislature, executive, and judiciary.

Drawing on historical wisdom, the Vice-President pointed out that power and authority, whether in an individual or institution, must be exercised with a consciousness of limitations, tempered by morality and propriety. He cautioned against the vulnerabilities that could arise if these democratic institutions were compromised, noting the dangers posed by forces with pernicious agendas operating both from within and outside the nation.

He also expressed concern over attempts to infuse narratives that could destabilize India, pointing to recent developments in neighboring countries as a cause for alarm. The Vice-President called for vigilance against anti-national forces that may exploit constitutional institutions to legitimize their actions, emphasizing that national interest must always take precedence.

Reflecting on India’s history, the Vice-President invoked the memory of the Emergency imposed by Prime Minister Indira Gandhi in June 1975, describing it as the darkest period since independence. He praised the Rajasthan High Court for its resilience during this time, standing firm against the draconian measures imposed by the regime, unlike the apex court, which had capitulated to unconstitutional mechanisms.

The Vice-President urged the legal fraternity to remain vigilant in safeguarding the independence of the judiciary and to educate future generations about the importance of upholding democratic values and the rule of law. He concluded by reaffirming the government’s commitment to observing June 25th as “Samvidhaan Hatya Diwas” to remind the nation of the perils of allowing constitutional transgressions to go unchecked.
