New Delhi, 15th May: The Supreme Court on Thursday announced that it will devote the entire day on May 20 to hear arguments on whether to grant an interim stay on the provisions of the contentious Waqf (Amendment) Act, 2025.
A Bench comprising Chief Justice of India B.R. Gavai and Justice Augustine George Masih directed all parties to submit a consolidated note of their arguments and relevant points of law in advance to avoid any adjournment. “We will not take up any other matters on Tuesday,” Chief Justice Gavai stated, urging lawyers to come fully prepared.
Solicitor General Tushar Mehta, representing the central government, and senior advocate Kapil Sibal, appearing for the petitioners, both agreed to the proposal to schedule a dedicated hearing next week to allow adequate time for the Bench to review the case documents.
The matter was last heard on May 5 by a Special Bench led by then Chief Justice Sanjiv Khanna, who expressed his inability to continue with the proceedings due to his impending retirement on May 13.
The Waqf (Amendment) Act, 2025 has been challenged in the Supreme Court on grounds of constitutional validity, with petitioners arguing that certain provisions infringe upon property rights and violate principles of natural justice.
The outcome of the May 20 hearing could determine whether the amended Act remains in force while the case is under judicial review.
