Supreme Court Directs AIIMS to Assess 25-Week Pregnancy for Termination

The Supreme Court on Tuesday directed the All India Institute of Medical Sciences (AIIMS) to form a medical board to evaluate the physical condition of a woman and her 25-week foetus. The woman, citing financial constraints, is seeking to terminate the pregnancy.

A vacation bench comprising Justices Dipankar Datta and Satish Chandra Sharma ordered that the medical board submit its report by May 27.

The order was issued following a plea by the woman, who claimed she discovered her pregnancy on May 17. “She has come all the way from Dubai and is currently staying in a hotel here. She is not that financially strong,” her counsel informed the bench, urging them to permit the termination.

The bench agreed to list the matter for next Monday. According to the Medical Termination of Pregnancy (MTP) Act, aborting a foetus older than 24 weeks is permissible only if a medical board diagnoses substantial foetal abnormalities or if it is necessary to save the life of the pregnant woman.
