Senior BJP leader Subramanian Swamy has filed a petition in the Delhi High Court seeking a directive for the Union Home Ministry to revoke Congress leader Rahul Gandhi’s Indian citizenship. Swamy’s petition claims that Gandhi had declared himself as a British citizen, warranting the cancellation of his Indian citizenship.
Swamy took to X (formerly Twitter) on Friday to announce that he had filed a public interest litigation (PIL) over the Centre’s failure to prosecute Rahul Gandhi or issue a show-cause notice regarding the status of his Indian citizenship. The petition requests the court to order a status report on Swamy’s earlier complaint against Gandhi and expedite its resolution.
In 2019, Swamy had written to the Union Home Ministry alleging that Rahul Gandhi violated Indian laws by voluntarily disclosing to the UK government that he was a British citizen. According to Swamy, Gandhi held a British passport and served as a Director and Secretary of a company registered in the UK.
Swamy’s complaint points to a company named Backops Limited, registered in the UK in 2003, where Gandhi was listed as a Director. In the company’s annual returns filed in 2005 and 2006, Gandhi allegedly declared his nationality as British. Additionally, the dissolution application for the company in 2009 also mentioned Gandhi’s nationality as British.
According to Swamy, this declaration violates Article 9 of the Indian Constitution, which deals with citizenship, and the Indian Citizenship Act, 1955. “By declaring himself as a British national, Rahul Gandhi ceases to be an Indian citizen,” Swamy asserted.
In his petition, Swamy said he had sent multiple representations to the Home Ministry seeking updates on his complaint, but has not received any response. The petition seeks an order directing the Home Ministry to furnish a status report on the complaint and to take prompt action based on its findings.
Swamy’s plea also asks for the earliest possible resolution to the matter, emphasizing the importance of clarity on Gandhi’s citizenship status.
