SC Forms Five-judge Constitution Bench Led by CJI DY Chandrachud

New Delhi, 28th June. The Supreme Court announced the formation of a new five-judge Constitution Bench on June 26 chaired by Chief Justice of India DY Chandrachud, with the bench expected to convene on July 12 and 13.

The bench would be composed of Justices Hrishikesh Roy, PS Narasimha, Pankaj Mithal, and Manoj Mishra, according to a notification issued on the top court’s website. The newly formed Constitution Bench will hear three cases ranging from arbitration law to motor vehicle legislation.

The following cases have been scheduled for hearing, according to the notification.

Tej Prakash Pathak Vs Rajasthan High Court:

The issue, which was referred to the Constitution Bench almost a decade ago, asks whether recruitment guidelines can be altered after the process has begun. The case was started after the Rajasthan High Court modified the qualifying percentage for translators after the written exam, which was challenged in the Supreme Court. The case was last listed in September 2022. However, no binding orders were issued.

JSW Steels Vs South Western Railway, Central Organisation for Railway Electrification Vs ECI:

The case is intended to lay down a rule about whether a person who is disqualified to be an arbitrator in a dispute can nominate someone to be an arbitrator. In 2022, it was referred to the Constitution Bench.

Bajaj Alliance General Insurance Company Ltd Vs Rambha Devi:

The case, which was instituted in 2017, asks whether a person having a driving license that allows them to operate Light Motor Vehicles (LMVs) can also operate LMVs of the transport class. LMV licenses have usually covered personal vehicles such as cars, but the court is set to rule on whether an LMV driving license also covers transport vehicles such as tempos.
