In response to the ongoing legal battle involving Patanjali Ayurved and its founders, Yoga guru Ramdev and his aide Balkrishna, the Centre has asserted that it is an individual’s prerogative to opt for healthcare services under Ayush or allopathic medicine. The Supreme Court received this reply from the Centre amidst the case concerning misleading advertisements by Patanjali.
The apex court expressed dissatisfaction with the Centre’s response and criticized Uttarakhand authorities for their delayed action against Patanjali. This follows the court’s rebuke of Patanjali’s founders for violating laws with their advertisements and failing to submit appropriate affidavits. The court, rejecting Patanjali’s apology last month, demanded fresh affidavits from Ramdev and Balkrishna.
The government’s reply clarifies that states have the authority to act against misleading advertisements promoting “magic remedies.” However, it asserts that the Centre has acted promptly within legal frameworks. Regarding Patanjali’s controversial claim of developing a Covid-19 cure with Coronil, the affidavit mentions that the Ayush Ministry advised against such advertisements until further examination.
The Centre emphasizes its policy promoting an integrative healthcare system, allowing individuals to choose between Ayush and allopathic medicine for their well-being. It discourages the denigration of any healthcare system, urging mutual respect and understanding among practitioners.
The Indian Medical Association (IMA) initially raised concerns about Patanjali’s advertisements in 2022, alleging false and misleading claims undermining allopathy and medical professionals. Uttarakhand’s government, where Patanjali Yogpeeth is headquartered, assures the court of its vigilance and commitment to ensuring legal compliance by Patanjali. Despite Patanjali’s reliance on a 2019 Bombay High Court interim order, the state pledges to take appropriate actions in compliance with the law and court directives.
