New Delhi, 8th Sep. The Supreme Court gave an important remark on Wednesday in the matter of deaths during the second wave of Corona. The court said that it cannot be inferred that all deaths due to corona during the second wave of the pandemic were due to medical neglect.
Saying so, the court has refused to entertain the petition, which had sought compensation to the family members of those who lost their lives due to lack of oxygen and essential health facilities during the difficult times of the pandemic. The petition was filed on behalf of Deepak Raj Singh. A bench of Justice DY Chandrachud, Justice Vikram Nath and Justice Hima Kohli asked the petitioner to approach the competent authorities with their suggestions and make their submissions.
The court concluded that the second wave of corona affected the entire country and in such a situation, it would not be correct to make general assumptions like negligence in treatment. According to the bench, as stated in the petition that all the deaths due to corona were due to negligence in treatment, the court cannot infer that.
The SC said that the National Task Force has been formed to look into all the aspects related to the pandemic. The bench also said that the court had also issued an order on June 30 to pay compensation to the families suffering from Corona. In a judgment on June 30, the Supreme Court had said that the National Disaster Management Authority has a statutory obligation to frame guidelines for recommending minimum ex-gratia assistance to the victims of the corona pandemic.
